Will Jose "Sway" Penala Be Uninvited?

Another gold ticket holding American Idol wannabe may have his ticket cancelled.
Sway Penala blew away the judges in San Francisco with his version of "Superstar" and was invited to Hollywood.
This time it is not a criminal record that was undisclosed or pending criminal charges. This time it appears Penala may have an existing record deal which is a clear violation of the rules.
You are allowed to audition for the show if you have had a prior deal that has expired. But if you have a current deal you are not allowed to participate in the show. It's pretty clear.
What is not so clear is does he have a current deal?
According to a Filipino newspaper is a member of the band 6th Day that was performing shows in a Manila shopping mall. He and his band reportedly have a contract with E-Real Records and that was in effect last August when he auditioned for American Idol. The band has a CD out called "Forever Starts Today".
A statement posted by the web master of Panala's web site says, "Please stop spreading these false rumors. Jose was not affiliated with anyone when he auditioned. He is not disqualified, and will not be. End of story. Just watch the show and see what happens."
FOX has refused comment. No surprise there. We'll watch the show and see what happens.
